Greetings all,
As another week grinds away in the financial markets, news about Barnett Shale leases continues to be in the news. Among the latest:

TITAN TERMINATES BC-MRC AGREEMENT

Thursday, October 23

Titan Operating has informed BC-MRC that it has terminated all leasing efforts with coalition members. Titan informed BC-MRC that it felt it necessary to terminate its agreement due to attempted acceptances by BC-MRC members of the previous lease offer which was recently suspended, and has notified BC-MRC that it considers such acceptances ineffective.

Titan has indicated that it will honor all executed lease agreements for which a bank draft has already been issued, including those signed Saturday, October 18 at a scheduled signing session in Euless.

Titan has indicated to BC-MRC that further leasing efforts may resume after a management meeting and a meeting with its financial partner(s) scheduled for next week. Titan expects to present a revised proposal to BC-MRC, the terms of which are currently unknown. Such proposal is expected to include a different bonus amount and possibly other changes from the existing or previous offer.

BC-MRC is extremely disappointed and strongly disagrees with this unilateral decision by Titan. It plans to consider all options at its disposal to seek to enforce the agreement which Titan has now repudiated, as should all individual members.

BC-MRC will continue to function as a coalition going forward. Titan has signed leases with approximately 15% of BC-MRC members, but needs far more acreage within BC-MRC boundaries to form effective drilling units. Therefore, BC-MRC retains significant economic power, and can also function as a source of political power if necessary.

We urge all of our members to stay united in what has developed into an extremely unfortunate situation for all of us. The Barnett Shale is not going away, our acreage still has potentially significant value and we should not feel pressured to accept something less than what has already been offered and accepted just because of claims that competitive conditions have subsequently changed.

As you probably know, BC-MRC is just west of NEEPO. Dozens of other coalitions throughout Tarrant County have also seen negotiations for lease rights come to a halt. I have been informed that Cimmaron Land Services (landmen for Chesapeake) has sent letters to folks east of Main Street notifying them that all previous lease offers have been rescinded!

It probably goes without saying; prospects for a favorable deal in the very near term are not too hopeful.  However, I would encourage everyone to remember – we have a natural resource under our property that is NOT going away! Maybe think of it as a 401k, fully funded for us - but not by us - that should be worth more in the future than it is today!  Certainly, you would not want to sell out when your asset is at a low price.  The analogy may be a little silly, but none the less, a year or two ago, most of us probably didn’t even know what the Barnett shale was, much less it’s value!  As your director for NEEPO, it is my firm belief that we will see demand for our “resource” increase in the months ahead. Will it have an all-time high signing bonus? No one knows! But in my opinion, as the financial world gets back on track and with the cold months of winter on the horizon, the demand for natural gas will bring new life to this present market.

Just an additional FYI: DFW airport signed their lease agreement on 18,000 acres with Chesapeake in April of 2006. The terms: $10,000 per acre signing bonus plus 25% royalties. So you may say, “What’s the point?” I’m glad you asked! Here are my points:  First, only 2 years ago, $10,000 per acre bonus was tops in the area and good enough for the largest owner of contiguous minerals in the area.  Second, the average wellhead price for natural gas in Texas for 2006 was $6.60/MCF1…about 45¢ LESS than today’s price!  Then why should we be led to believe that at today’s gas prices, our gas is somehow not as valuable?  Third, DFW Airport focused on the terms of the lease that will be around for years to come, and so should we.  The bonuses may very well be spent in a few weeks, whereas production and the contractual relationship may last for one or two generations.  Let's keep this in perspective. Folks, we do have a valuable commodity under our homes – please be patient – one or more of these drillers will want what we own at some point in the near future. Remember, a year or so ago, we had nothing to gain; today we have nothing to lose by waiting. I would encourage everyone not to cash in their “free 401k” while the market is down.

NEEPO Update – 13 Oct 2008

What A Difference A Month Makes!

Just over a month ago, your negotiating team held an all-NEEPO meeting to inform our coalition members about the progress being made to secure a lease agreement with one of several drillers. Hopes were high as the Barnett Shale drew new competition from entrants like Vantage Energy (SW Ft. Worth) and Titan Operating (CAMRA; NAN; etc.).  At the end of September we saw the BC-MRC (Bedford Colleyville-Mineral Rights Coalition), just west of NEEPO, reach an outstanding arrangement with Titan! Then came September 29th; day 1 of a 10 day free fall in the financial world, the worst such period in the history of the market. News in the Star-Telegram has recently pointed out that many drillers have cut back or stopped exploration because of falling gas prices and a general uneasiness about the world economy and availability of advanced loans! So now we ask, “Where does that leave NEEPO?”

 

There is no simple answer. I have been in discussion with our negotiators as we continue to see what options, if any, are available to our coalition members. Although many of the drillers like XTO and Chesapeake appear to have no plans to curtail their  production, there are reports that they will be reducing their leasing activities outside, and possible inside, the Barnett Shale.  In part, this is a function of their having possibly over-extended their inventories of leased acreage and realizing that it will be a daunting task to drill it all before lease expirations.  Vantage and Titan may do likewise, although they have given no public indication of that. With that said, let me address some questions that are on the mind of many folks.

 

  1. Q: Why didn’t we just make our deal like 360NW and BC-MRC?

A: We cannot “force” a driller into an agreement. They are the “buyer,” and to date no company has made an offer to NEEPO as a whole. The best we can do is to be prepared by being organized and unified, which we have done quite well! In fact, we are so well organized, we hired an attorney almost six weeks ago and initiated talks with several drillers to obtain a lease!

 

  1. Q: NEEPO started organizing months before BC-MRC, how come they got a deal and we didn’t?

A:  The simplest reason was the number of potential drill sites. Along with being almost 4 times the size of NEEPO, BC-MRC has at least seven (7) potential  drill sites which can reach inside their footprint, including into Bedford, which is no easy task.  NEEPO has very limited open property that would qualify as a drill site. That’s not to say NEEPO is of no value to a driller, it just means that we have to excel in the other factors of importance.  It is still possible that one or more of these “potential drill sites” surrounding NEEPO may arise from this present activity and that would be to our advantage. 

 

  1. Q: So what’s our next step? Where do we go from here?

A:  Patience is still the operative word. As you’ve seen on TV, the Barnett Shale is not going away and the millions of dollars worth of natural gas under the homes in NEEPO is not going away either! Our day will come, but no doubt the present market is not in our favor for a quick deal. Remember, the driller signs a lease that gives them three years to begin drilling! Who knows what the market will look like next month, or thereafter, but one or more of them will want our lease.

 

  1. Q: What about the offers made by Cimarron to folks east of North Main St?  Should we just take that offer now?

A:  We understand why people might be tempted to try to accept a lease offer that may have looked attractive to them.  Remember, you can sign with any company at any time as you see fit. The MOI with NEEPO is just that, a memorandum of “intent” with no legally binding power. It may be likely that the companies who had offers outstanding will reduce or eliminate their offers in the current environment until things clear up a bit.  There is probably no better example of how surprised companies were with the severity of this recent decline than the fact that, Chesapeake’s chairman sold all his holdings in the company last week due to forced margin calls.    

 

To repeat, the recent turmoil in the markets has created much uncertainty about the direction of many things, including oil and gas prices and the terms companies may be offering for leases.  Additionally, please let me make this point very clear: NEEPO has not in any way stalled or delayed our negotiations. We approached the drillers in anticipation of striking a deal over four weeks ago and we will continue to position NEEPO to the best of our ability to take advantage of the best deal available in the market. But we have to caution everyone that, at least for now, things may have changed just within the past week – all of which was beyond our control. However, the long term resource beneath our land has not changed.

 

Having been out of the country for three weeks, I take personal responsibility for the delay in providing this update. It will be my goal to provide information on a more regular basis in the days ahead. Please know that your negotiating team is doing all that is possible to provide as good a deal as possible as soon as possible!

WOW!  Great Meeting Yesterday

Just a quick update:

Dale and our leadership team did a great job last night (Sept 11th) and THANK YOU for coming out to hear about the progress.  We had a big big turn out!!!  Please pass on the information and tell your neighbors that did not come or who have not submitted their contact information to get it in to their area leader.  We are proceeding quickly and really want to spread the news as progress is being made.

Update for 30 August 2008 
Just a quick update:
Talks are continuing with several drillers. As you can imagine, the process is slow and laborious! But progress is being made. There is some thoughts of grouping up with the Bedford Colleyville Mineral Rights Coalition (BC-MRC) and/or the East Bedford coalitions to form a more favorable appeal to the various drillers; the more acreage - the more leverage. Likewise, the more competition among the drillers - the better! The one concern most drillers have about NEEPO is the availability of a drill site. At the present time, there doesn't seem to be a readily available site that would tap all of NEEPO. I'm sure most of you know about the possible site next to Bob Eden Park (BEP). It is still a viable site, but will require some extensive restructuring of governmental oversight and various regulations in order to make it a reality. That to say, it could be several months (8-12?) before BEP could become a drill location! Does that mean NEEPO doesn't have a chance for a quicker settlement?  Not necessarily. With improved drilling techniques and competition amongst the drillers, they may very well want to get a lease with us and "find" or "make" a drill site later. I again ask everyone to be patient - I am all but positive we will strike a deal; it just might take a bit longer than we'd like. Hang in there with NEEPO, there is certainly NO advantage to signing a low ball lease from a landman. Feel free to share this with your 'hood. I will keep all of you apprised of new developments as they arise!

Greetings all!

 As we’ve seen in recent weeks, the Gas Man is getting close to NEEPO!

 In case you haven’t followed recent announcements:

  •  DFW West (Grapevine) signed with XTO for a bonus of $19,500/acre, then
  • White’s Chapel (Southlake) signed with XTO for $22,500, then
  • 360 NW Coalition (Grapevine/Euless) signed with Chesapeake for $23,500, then
  • Timarron (Southlake) signed with XTO for $24,000, and most recently
  • CAMRA (Colleyville) signed with Titan Resources for $25,000

The CAMRA agreement in particular contains terms and conditions that are very favorable to the landowners, not just on the signing bonus, but on issues like environmental and other protections.  So, as one can see, competition for lease agreements in NE Tarrant County is going strong (and prices are still going up!), and NEEPO and the group to our immediate west, Bedford Colleyville Mineral Rights Coalition (BC-MRC - http://www.bc-mrc.com/ ) are the last of the “big” tracts to be signed!  And it is not just about the bonus, which will vary based on things like the ability of a partner to drill quickly, access to easily permitted  drill sites, acreage coverage, proximity to existing infrastructure, environmental hazards, etc.; some areas around Ft. Worth have seen bonus amounts in the $25-30,000 range as a result of these factors.

 

So what does this mean to you and me? What is your NEEPO leadership planning? What’s next?

 

First, I would still ask everyone to be patient and work on getting those MOI’s signed for your ‘hood – we still need strength in numbers! Some NEEPO ‘hoods have already been approached to sign a low-ball lease with no doubt, unfavorable T&C! So we recommend again:

 

DO NOT SIGN ANY LEASE - YET!

 

The negotiating committee for NEEPO has been established with the following individuals:

The single negotiating goal of NEEPO remains:

 

Negotiate the best lease deal, with the largest signing bonus and superior T & C, as soon as possible, for everyone in NEEPO!

 

To that end, negotiations have started! We are in the very early stages of talks with more than one driller. Once negotiations begin, the time table usually depends on the pace of the gas company(s). Please understand, we all want to see an agreement happen soon, but not at the expense of leaving significant monies on the table or in the environmental and other legal protections in the lease. I would ask everyone again; trust us to do the right thing! We are all in this together and your negotiators will use the excellent expertise available to achieve our goals!

 

Finally, it will be our desire to have an all-NEEPO meeting (2500+ homeowners) within the next 30-45 days. By the end of this time frame, we should have a pretty good idea about who will be the real players in our negotiations, what to expect next in the process, and possibly - and I say again, possibly - a time line to a signing! Some recent lease agreements have taken 3-6 months– I would hope ours does not!  We do not plan to re-negotiate every item in a lease from the beginning, or hold out for the last $, nor hold out for unreasonable demands.

 

PLEASE BE PATIENT! It will be worth it!
